COMAL COUNTY, Texas -- A 12-year-old Comal County boy who was hit by a pickup as he got off a school bus last Friday has died.Ryan Padilla died at University Hospital Monday afternoon. The Smithson Valley seventh-grader had just gotten off his bus and was heading to his house when an oncoming vehicle struck him.The driver who hit the boy could face some very serious charges.
"If Ryan Padilla would have seen that pickup coming, he would have moved," said Rick Alvarez, of the Texas Department of Public Safety. "He never saw it coming. He gets off the bus and then he gets hit."Texas Department of Public Safety troopers investigating the accident said the bus had its warning lights flashing, but the driver of the pickup, 68-year-old Roy "Mac" Miller Jr., claims he didn't see them.DPS troopers said that he was fumbling with a pack of cigarettes at the time. Troopers said Miller passed up four vehicles and the bus on the right shoulder of FM 3159 before hitting Padilla.Miller was not under the influence of drugs or alcohol, just distracted, police said."I don't care what distraction is in your vehicle, it's not worth hurting yourself, hurting someone else or damaging property," said Alvarez. "It's not worth it. I don't care what it is, whether it's a radio you're adjusting or a cell phone to your ear or a dog on your lap, or a cigarette on your console. It's not worth it."Smithson Valley ISD has been offering counseling to students since the accident and will continue to do so for Padillas' classmates.Miller is facing two pending charges. One is criminal negligent homicide or the more serious charge of manslaughter, which is a second-degree felony.Comal County's district attorney is reviewing the case and a grand jury is expected to examine it soon.
